Review of Writ Petition

A Review of a Writ Petition is filed before the same Bench of the High Court that decided the writ proceedings, seeking reconsideration of the judgment or order on grounds strictly recognised under the Code of Civil Procedure and the applicable High Court Rules. It is not an appellate remedy and does not permit fresh arguments or reappreciation of the merits.

Permissible grounds for Review in Writ Petition

Error apparent on the face of the record

A patent, self-evident error of law or fact visible from the record itself, requiring no elaborate argument or inference to establish.

Discovery of new and important matter

Material evidence or facts that were not within the knowledge of the petitioner at the time of hearing and could not have been produced despite the exercise of due diligence.

Mistake or omission by the Court

An inadvertent mistake or omission in the judgment that has materially affected the rights of the parties or the outcome of the writ proceedings.

Non-consideration of a binding precedent

Failure to notice or apply a directly applicable and binding decision of the Supreme Court or a coordinate Bench of the High Court that was brought to the attention of the Court.
